Rechters voor Rechters werd door Advocaten voor Advocaten geattendeerd op de situatie in Lesotho, een mini staatje in Zuid-Afrika. Daar circuleert een “hitlist” met advocaten die het leger onwelgevallige procedures voeren. Het gaat dan bijvoorbeeld om het bijstaan van militairen die om onduidelijke redenen worden vastgezet. Een van die advocaten is ook daadwerkelijk vermoord.
We hebben de situatie onderzocht via het netwerk dat Rechters voor Rechters heeft in Zuid-Afrika. We vernamen toen dat ook de rechterlijke onafhankelijkheid zwaar onder druk staat in Lesotho. De president van het Hof is bijvoorbeeld afgezet en vervolgd, zogenaamd vanwege belastingtechnische redenen. Overduidelijk is dat dit een politieke actie is.
Wij hebben de Chief Justice van Lesotho laten weten dat wij steun verlenen waar en wanneer dat nodig en opportuun mocht blijken. Daar is met dank op gereageerd. Mogelijk volgt er dit jaar een factfinding mission waar Rechters voor rechters aan deelneemt. En daarnaast wordt de mogelijkheid van proceswaarneming overwogen als de zaak van de president van het Hof in appel wordt behandeld.
In samenwerking met het Zuid-Afrikaanse Southern Africa Litigation Centre (SALC) en de International Commission of Jurists (ICJ) houden wij de situatie nauwlettend in de gaten.

Colombia Caravana | The Netherlands
Na mijn deelname aan de Colombia Caravana 2014 hebben Wout Albers, (lid van advocaten voor advocaten) en ik (Anne-Marie Smit) contacten gelegd om een Nederlandse tak van de Colombia Caravana op te richten om de Britse afdeling aan te vullen. Met toestemming van de Britse tak is op 18 september 2015 een Nederlandse stichting opgericht waarbij Wout Albers (secretaris), Laura van den Boogert (penningmeester) en ikzelf als voorzitter de Raad van Bestuur vormen. In 2014 geschiedde de organisatie van de Caravana geheel door Groot-Brittannië. Ik wist kort voor vertrek niet naar welke stad ik zou gaan en wat het programma zou inhouden. Bijeenkomsten werden soms op het laatste moment gepland, dan wel ter plekke door de deelnemers georganiseerd.
Met een extra organisatie in Nederland zouden we de Britse tak niet alleen kunnen bijstaan, maar ook invloed kunnen uitoefenen op het programma en de ontmoetingen. De Caravana 2014 was in het bijzonder gericht op advocaten en mensenrechtenactivisten en minder op de situatie van rechters. Mijn doel bij de oprichting was onder meer bij de verdere contacten meer op de situatie van rechters te focussen. Bijvoorbeeld op de situatie van rechters die betrokken zijn bij het landrestitutie programma. In Colombia bestaat er een land restitutie programma dat er op papier heel mooi uitziet maar voor de rechters lastige zaken tot gevolg heeft. Boeren zijn als gevolg van geweld van terroristen of paramilitairen van het land getrokken, dat vervolgens soms door grote bedrijven in gebruik is genomen. Uit de ontmoeting met rechters in Medellin tijdens de Caravana van 2014 waar dergelijke zaken aan de orde zijn, werd de bescherming die de rechters daarbij ondervonden als onvoldoende geoordeeld.
Een van de eerste activiteiten van onze Caravana was de ontvangst van Edwin Rubio. Edwin Rubio is een mensenrechtenadvocaat uit Colombia die tevens voorzitter is van de Vereniging van Verdedigingsjuristen “Eduardo Umaña Mendoza” (Asociación Colombiana de abogados defensores “Eduardo Umaña Mendoza”, ACADEUM), een overkoepelende organisatie voor Colombiaanse mensenrechtenjuristen. ACADEUM is de organisatie die ons uitnodigt voor de Caravana. Naast bezoeken die hij heeft afgelegd onder andere aan Pax en buitenlandse zaken was hij ook aanwezig bij eerder genoemd bezoek aan de ambassade waarbij het rechtersrapport is aangeboden. Ook heeft hij een gesprek gehad met Tamara Trotman de voorzitter van rechters voor rechters. Een interview met hem is te vinden onder onderstaande link.
Protest of Bulgarian judges and open letter to Bulgarian citizens
Judges from several courts in Sofia staged a protest in front of the Palace of Justice Friday evening December 11th 2015. The president of the Supreme Court of Cassation was one of them. The protest – along with other protests – followed the Parliaments refusal on December 9th to support constitutional changes proposed by the Minister of Justice, Hristo Ivanov and relating to judicial reform and the composition of the Supreme Judicial Council (SJC). Right after the vote, Ivanov, announced his resignation, which was accepted by the Prime Minister Borisov. His deputies also resigned.
Last year Ivanov presented a package of legislative proposals aiming at the decrease of political influence over the judiciary and the division of the SJC in two separate colleges – one for judges and the other for prosecutors. Ivanov did not receive enough support from the ruling political party (GERB) and to a large extent, his proposals were rejected in parliament. In July 2015, a political compromise was reached on the division of the SJC: the judges’ college should have thirteen members – the presidents of the Supreme Court of Cassation and the Supreme Administrative Court, six judges elected by their peers and five members elected by the Parliament. The prosecutors’ college should have twelve members – the Prosecutor General, five prosecutors elected by their peers and six members elected by the Parliament.
Last Wednesday, the Parliament voted on different quota for the members SJC. The result is a higher number of political appointments in the judges’ college, and a stronger hand of the prosecutor-general in the prosecutors college.
The Bulgarian Judges Association (BJA) played an important (advisory) role in the reform process. After the Parliaments vote, the BJA addressed the citizens of Bulgaria in an open letter – a historic move – and explained why this issue is so important: “it gets down to the most fundamental problem – which is whether we can have judicial courts that are independent of politicians and whether we can rely on a prosecutor’s office which is independent of political interference”.

In het decembernummer van het tijdschrift Trema wordt aandacht besteed aan het onlangs verschenen fotoboek ‘Law & Order’.
In de verschillende thematische fotoseries van Jan Banning klinkt steeds zijn maatschappelijke betrokkenheid door. Zijn werk is opgenomen in collecties in de hele wereld en is in Nederland bijvoorbeeld ook aangekocht door het Rijksmuseum.
Op zijn site (www.janbanning.com) staat over zijn nieuwste fotoboek ‘Law & Order’ onder andere het volgende geschreven:
Law & Order is een ongebruikelijk en innovatief boek over strafrecht waarin de wereld van de kunst gecombineerd wordt met die van de juridische wetenschap. Banning fotografeerde bij politie en rechtbanken en in gevangenissen in Colombia, Frankrijk, Uganda en de Verenigde Staten van Amerika.
Het boek bevat voorts een essay van Banning over strafvervolging, en een aangrijpend verhaal van Michiel Scholtes die zelf jarenlang gevangen zat in Frankrijk. Juridische experts van het Max Planck Instituut (MPI) in Freiburg, Duitsland geven korte inleidingen op de rechtssystemen van de vier landen, plus infographics over criminaliteit en strafrecht in deze en een selectie van andere landen. Ulrich Sieber, directeur van het MPI, schreef het voorwoord.
Deze veelzijdige collectie foto’s, teksten en statistieken roept vragen op over strafrechtbeleid die politieke gemeenplaatsen en populaire clichés ontkrachten.
Afgesproken is dat 10% van de opbrengst van de Law & Order – boeken die door de lezers van Trema wordt besteld, wordt gedoneerd aan Rechters voor Rechters. Een prachtig gebaar!

Actie voor de vermoorde Filipijnse rechter Erwin Alaba
Op 1 september 2015 is de Filipijnse rechter Erwin Alaba vlak voor het gerechtsgebouw doodgeschoten. Rechters voor Rechters heeft in samenwerking met Lawyers’ Rights Watch Canada (LRWC) een brief aan Alfredo Benjamin S. Caguioa, de nieuwe staatssecretaris van Justitie van de Filipijnen gestuurd waarin aandacht wordt gevraagd voor deze gebeurtenis. Er bestaan indicaties dat zijn moord samenhangt met het rechterlijk werk van Alaba. Rechter Alaba had gewerkt aan een aantal gevoelige zaken. Rechters voor Rechters en LRWC roepen de Filipijnse autoriteiten in de brief onder verwijzing naar o.a. de Basic Principles on the Independence of Judges en de Principles on the Effective Prevention and Investigation of Extra-Legal, Arbitrary and Summary Executions van de Verenigde Naties op om een gedegen onderzoek te verrichten naar de moord. Daarnaast is in de brief verzocht om op de hoogte gehouden te worden.

In writing this short preface to this newsletter I am looking back at a week full of activities by Judges for Judges. We have been busy preparing for print a new edition of the booklet ‘Matters of Principle’, while this week also saw the fourth time Judges for Judges met with a new group of trainee judges at SSR, the Study Centre for the Judiciary, and discussed core values, codes and straight-backed judges. Looking forward I am delighted to go and see – as a member of the jury – the films that show at the ‘Camera Justitia Program’ at the upcoming ‘Movies that Matter Festival’, and meet the inspiring guests that will speak at this festival.
This newsletter contains relatively a lot of good news, for example about dismissed judges who have been re-instated after years of proceedings and international pressure – including by us.
Sadly, we also have to conclude that nothing has changed for the better in the case of Venezuelan judge Maria Afiuni. The executive there does not seem to value a real independent judiciary. The question remains when things will change for the better.
In conclusion, I would like to say that by far not all activities by Judges for Judges are related in our newsletter: not every case benefits from publicity. I do want to mention that in the last couple of weeks we have had very constructive talks with the Centre for International legal Cooperation (CILC) and with Justice & Peace about their lovely project Shelter City Netherlands. The talks provided a good opportunity to get to know each other and to see how we could mutually reinforce our activities.

En el momento de escribir el prólogo de este boletín miro hacia atrás a una semana llena de actividades de JJ. Así estamos ocupados preparando la impresión del librito Matters of Principle. También era la cuarta vez que JJ, junto con una nueva quinta de jueces en formación, en un curso de SSR podía estudiar detenidamente sobre valores claves, códigos y jueces con la espalda firme.
Si miro adelante ¡espero con impaciencia las películas que veré por JJ como miembro del jurado del programa de Camera Justitia en los próximos días durante el [Festival Movies that Matter] y a los invitados inspiradores que se puedan ver y escuchar allí!
En este boletín encontrará relativamente muchas noticias buenas, por ejemplo sobre jueces que fueron destituidos de sus funciones -por lo cual nos hemos preocupado anteriormente- en Sri Lanka y Ucrania, que después de años de procedimientos y presión internacional han sido restituidos a sus funciones.
Desgraciadamente a la vez tenemos que constatar que nada ha redundado en beneficio para la venezolana Maria Afiuni. El poder ejecutivo de momento no parece apreciar una jurisdicción realmente independiente. Queda aún por ver cuando cambiará la situación allí.
Por último añado que no todas las actividades de JJ estarán explicadas en el boletín, ya que no todos los casos sacan provecho de la publicidad. Sí quiero mencionar que en las últimas semanas hemos tenido conversaciones constructivas con CILC [Center for International Legal Cooperation, Centro para Colaboración Legal Internacional] y con [Justice & Peace (Justicia y Paz)] sobre su buen proyecto Shelter City Nederland. Eso para conocernos mejor y ver cómo podemos reforzarnos mutuamente.
¡Me alegro que querrá tomar el tiempo de leer sobre los jueces que necesitan (o necesitaban) nuestro apoyo!

Case of Baka v. Hungary has been referred to Grand Chamber of the ECHR
At its last meeting (Monday 15 December 2014), the Grand Chamber panel of five judges decided to refer one case and to reject 13 other referral requests.
The following case has been referred to the Grand Chamber of the European Court of Human Rights.
Baka v. Hungary: which concerns the premature termination of the applicant’s mandate as President of the Supreme Court of Justice of Hungary and his lack of access to court to challenge the termination.
